The Pentagon said it is reviewing Sen. Mark Kelly’s participation in a video urging service members to refuse unlawful orders, and said he could face military or administrative proceedings. The review follows President Donald Trump’s remarks condemning the video and saying the conduct was punishable by death.
The Defense Department said it was reviewing Kelly’s actions and could recall him to active duty for possible court-martial proceedings or administrative measures. Defense Secretary Pete Hegseth said Kelly was subject to military law because he is retired military, and said Kelly’s conduct brought discredit on the armed forces. The article describes statutes the department cited and the Pentagon’s position that service members must obey lawful orders.
Kelly and five other congressional Democrats appeared in a video saying service members can and must refuse illegal orders. Trump called the video “seditious behavior” and said it was punishable by death, then said in a radio interview that he was not threatening death. The lawmakers said threats would not deter them; Kelly and Sen. Elissa Slotkin also discussed security concerns, while the article reported threats directed at Rep. Jason Crow and a bomb threat at Rep. Chrissy Houlahan’s district office.
