Brian Cole, accused of placing pipe bombs outside the DNC and RNC in January 2021, is seeking release while awaiting trial. A federal judge deferred a decision on whether Cole should remain jailed or be placed under house arrest.
Cole’s attorneys cited his autism diagnoses and lack of a prior criminal record in arguing he would not pose a threat if released. Prosecutors argued he continued buying bomb-making components after the incident and had components in his car this month; they also said he repeatedly reset his phone.
The Justice Department said Cole had been living with family and working at the family business when he researched and constructed the bombs, and that he told investigators he acted out of frustration with the 2020 presidential election. Investigators said the bombs could have killed people. Judge Matthew Sharbaugh also has to decide whether he can accept an indictment from a Washington, D.C., local court and said he planned to rule on Cole’s detention within days.
