A federal judge ruled that Defense Secretary Pete Hegseth unconstitutionally retaliated against Sen. Mark Kelly over a video urging service members to refuse illegal orders. The ruling, alongside a grand jury’s refusal to approve charges against Kelly, blocks two efforts to punish him over the video.
Senior U.S. District Judge Richard Leon ruled that Hegseth’s efforts to punish Kelly violated the senator’s First Amendment rights. The Pentagon had announced administrative action that could reduce Kelly’s retired military rank and pay and issue him a letter of censure. Hegseth said the administration would appeal.
The ruling came two days after a Washington grand jury declined to approve charges prosecutors sought against Kelly and other Democratic lawmakers who appeared in the video. Kelly praised the ruling but said he expected the administration to keep fighting it; prosecutors could try again to obtain indictments.
