The Defense Department says it has opened a review of Sen. Mark Kelly over his participation in a video telling service members they can refuse illegal orders. Kelly said he first learned of the review from Defense Secretary Pete Hegseth’s social media post and called the effort intimidating.
The Defense Department said it had received allegations of misconduct against Kelly and opened a review that could lead to a recall to active duty for court-martial proceedings or administrative measures. Hegseth said the review focused on Kelly because he is retired military and remains subject to the Uniform Code of Military Justice. The department said it would limit further comments to preserve the proceedings’ integrity.
The review followed a video in which Kelly and other Democratic lawmakers told service members they could refuse illegal orders. President Donald Trump criticized the lawmakers and called for them to be jailed, while Kelly said he would not be silenced. Hegseth said Kelly’s conduct brought discredit on the armed forces.
