Modern Worker Empowerment Act
- Defines independent-contractor status: Under the Fair Labor Standards Act, a person would be an independent contractor if the other party does not exercise significant control over how the work is done and the worker has the opportunities and risks of entrepreneurship. The test would disregard control over the final result and would not allow employee status to be based on requirements to follow the law, meet specified health and safety standards, carry insurance, or meet agreed performance standards such as deadlines
- Uses the same test for labor relations: The National Labor Relations Act would use the Fair Labor Standards Act test to determine whether a person is an employee or an independent contractor
- Applies the test to future determinations: The new rules would apply to employee-or-contractor determinations made on or after the date of enactment
