Studying NEPA’s Impact on Projects Act
- Report on NEPA lawsuits: Each lead agency would send the Council on Environmental Quality (CEQ) an annual report identifying active lawsuits alleging NEPA violations, including the parties, courts, legal claims, status and outcomes. The reports would also describe outcomes such as whether an agency action was set aside, a project was allowed to proceed, or a case was settled
- Track review length and costs: Agencies would report the page counts and estimated preparation costs of environmental impact statements, including agency staff and contractor costs. When practicable, cost estimates would also cover cooperating agencies, participating agencies and project sponsors
- Measure environmental review timelines: Reports would track key dates in environmental impact statement reviews, from a project permit application through the agency’s notice to proceed, and give average and median timelines and trends. Through 2033, the reports would separate data from before and after the Fiscal Responsibility Act of 2023
