FIRE Act
- Broaden qualifying exceptional events: The bill would treat some human activities intended to mirror natural events, as well as events unlikely to recur, as exceptional events. It defines wildfire-risk mitigation actions to include prescribed fires and similar measures carried out under state-approved practices, and lets related monitoring data be considered for exclusion from certain air-quality decisions
- Revise EPA data-handling rules: The EPA would have to revise its rules for reviewing and handling monitoring data affected by exceptional events or wildfire-risk mitigation actions. The rules would cover when states can petition to exclude such data from decisions about pollution-standard violations, area designations, attainment, and other listed matters
- Require analysis of regional events: When multiple states notify the EPA that they intend to petition over the same air-quality event, or the EPA determines a multistate event occurred, the agency would have to conduct regional modeling and analysis to support the required demonstration
