Veterans 2nd Amendment Protection Act

  • Restrict VA reporting to NICS: The VA could not send a beneficiary’s personally identifying information to the Justice Department for the National Instant Criminal Background Check System solely because the VA pays that person’s benefits to a fiduciary. The exception is when a judge or other judicial authority finds that the beneficiary is a danger to themselves or others
  • Notify the Attorney General about prior disclosures: Within 30 days of enactment, the VA would have to tell the Attorney General that the basis for covered disclosures made on or after November 30, 1993, does not apply or no longer applies
  • Limit mental-defective designations: The VA could not treat someone as having been adjudicated a mental defective solely because the VA found the person mentally incompetent or decided they needed a fiduciary
