Nationwide Consumer and Fuel Retailer Choice Act of 2025

  • Allows year-round sales of E15: The bill would extend the Reid vapor pressure waiver now available to gasoline blended with 10% ethanol to blends containing 10% to 15% ethanol, allowing them to be sold year-round. It would remove existing state exclusions, while allowing states to submit new documentation supporting an exclusion after enactment
  • Cuts small refinery obligations: Beginning in calendar year 2028, the EPA would reduce renewable-fuel compliance requirements by 75% for each eligible small refining company. A company would lose this reduced requirement if its average aggregate daily production of obligated fuels exceeds 75,000 barrels in 2026 or any later year; the bill also bars reallocating its reduced obligation to other parties
  • Creates at-risk refinery exemptions: Starting in 2028, a qualifying small refinery could seek a one-year exemption if renewable-fuel compliance costs alone put it at imminent risk of closure, permanent idling, or conversion to renewable-fuel production. The bill sets requirements for the petition, public disclosure, EPA action, and a cap on the total renewable-fuel volume that may be exempted
