The Supreme Court upheld birthright citizenship for children born in the United States, regardless of their parents’ immigration status, in a 6-to-3 decision. Chief Justice John Roberts wrote that the 14th Amendment guarantees citizenship; Justice Clarence Thomas dissented, while Justice Brett Kavanaugh said he would have rejected President Trump’s executive order under federal law but left open the possibility of congressional limits.
